Creators of GTA - SUED.

NEW YORK (Sept. 6) - The family of a slain motorist has filed suit against the maker of a video game that two teens claim inspired them to shoot at passing cars on a Tennessee highway.

Grand Theft Auto, a video game that allows players to "fire" on people and cars in realistic, shoot-'em-up fashion, is a cash cow that propelled manufacturer TAKE2interactive to the top of the video game industry. For the middle and high school students who play the game for hours on end, it's a means of escaping the monotony of teenage life.

But for two stepbrothers, 16-year-old William and 14-year-old Joshua Buckner, that escape turned deadly this summer. They told police they were emulating Grand Theft Auto on the night of June 25 when they took shotguns to Interstate 40, near their Newport, Tenn., home, and opened fire on vehicles.

A Bullet Through the Window

The boys told police they did not mean to hit people, but the results were catastrophic.

"I have eight bullet fragments all in my body," said 19-year-old Kimberly Bede, of Moneta, Va., who was hit in the pelvis as she rode in the passenger seat of her boyfriend's car. "The bullet entered my hip and I'm still receiving medical treatment."

Aaron Hamel, a 45-year-old registered nurse from Knoxville, Tenn., traveling in a separate car, was killed.

"We had a beautiful day in the mountains, and we were heading back home to Knoxville," said Hamel's cousin, Denise Deneau on ABCNEWS' Good Morning America Friday.

"We were talking, laughing, listening to music and all of a sudden my cousin told me to look at the beautiful flowers. And as I did that, my glass shattered and I felt heat across my face," she said.

When Deneuau saw the glass and blood she thought she had been shot, but when she realized the car was out of control, she looked at Hamel. "He had a large bullet hole at the side of his head," Deneuau said.

After the car made it across the highway, passing oncoming traffic, it stopped at the guard rail.

Deneuau said she knew her cousin would die quickly from the nature of the injury. "I reassured him that I was OK and that I would take care of his pets and I told him that I loved him," she said.

Family members say the nature of Hamel's death is especially ironic because he had volunteered to work at a Tennessee facility for wayward teens shortly before the shooting.

Teens Plead Guilty, Lawsuit Filed

The teenage shooters, who each pleaded guilty to reckless homicide, aggravated assault and reckless endangerment, will be held at a state juvenile detention center until they turn 19. The law in Tennessee allows them to remain in the custody of the state Department of Children's Services until they are 19, but no longer.

In written statements, the boys expressed remorse for their actions.

"I will always hate myself for what I did. I am so sorry," wrote William Buckner.

"I didn't want to hurt anyone," wrote Joshua Buckner. "This will be with me the rest of my life."

The Hamel family hired attorney Jack Thompson and filed suit Thursday against TAKE2interactive, the video game maker. Thompson says it's time to send a message to the video game makers.

"We want to send a message with a huge verdict to Sony and TAKE2interactive and the entire video game industry that if they're going to continue to market adult-rated games to children with these horrific consequence, then we're going to take their blood money from them and send a message to their boards that they have to stop this practice or there will be other suits on behalf of other people, killed by these games," Thompson said.

TAKE2interactive declined to comment to Good Morning America about the incident.

Are Parents the Gatekeepers?

It's not the first time the game Grand Theft Auto has been linked to bouts of real-life violence.

A gang of teenagers in California, charged with plotting carjackings and murder, say their actions were inspired by playing Grand Theft Auto, morning, noon, and night.

In Oakland, Calif., a group of young people who called themselves the "Nut Cases" told police they played violent video games before going out and robbing and killing random victims on the street. They said their favorite was Grand Theft Auto. The five men and one woman are facing charges in dozens of robberies and five killings that took place in 2002 and early 2003.

The Entertainment Software Association, which represents the video game industry, pointed to research showing that youth crime has gone down even as video games have proliferated. The games are rated for violence, and ultimately, parents make the decisions about what games they bring into their homes, the association said in a statement.

"Parents are present at and involved in the purchase or rental of games 83 percent of the time, according to a September 2000 Federal Trade Commission report," the association said.

Family members of those killed in video game-related shooting sprees say it is time to take Grand Theft Auto off the market, before more lives are lost.

Bede, who says she will never fully recover from the incident that left bullet fragments in her body, isn't satisfied with the sentence the Buckner boys received. "I really don't think they got what they deserve," she said.

Its pure crap as all of these 'media inspired/influenced' crimes you hear about.

Im not gonna disagree that games/movies/music can put ideas in your head. As it honestly can, Im sure lots of us get carmageddon styled visions in our head while were driving down the street hehe. But for the people who actually carry these actions out, heh they're just plain stupid and probably would do it anyways. Think of the millions of people who plays these games and DONT do retarded things like that, its like 10,000 to 1. And like I, im sure a lot of people actually use these games to do that type of stuff rather then carrying them out in real life :lol:

There will be stupid peolple out there doing horrible things if there are games or not. Its just a part of life, heh go back to ancient times, Smelly cavemen didnt need a game or a movie to inspire them to pick up a huge rock and clobber another smelly caveman over the head.

bullshit. the gaming company should win the case, because down in the corner of the game case, its rated MA, for adults only. and since the kide are 14 and 16, neither of them are adults yet. so i dont even wanna hear it. its pure bullshit. i know alot of us teen have the game but still, its the kids fault, and they were probably lying about it anyway. i mean yea, it puts idaeas in your mind, but still. its just pure BULLSHIT. This, like every other lawsuit about video game violence, is rediculous to say the least. All I have to say, is where the fuck were these kids parents? Everyone wants to blame the video game, but what about the irresposible parents that let thier children play violent video games and watch violent movies without any kind of guidance to make sure they know it's just all pretend and the difference between real life and a video game.

It's really making me sick watching all these irresponsible parents that think TV and video games can educate thier children, or the ones who make up excuses like "I'm just too busy". Yet when shit hits the fan, everyone points the finger at video games and movies, rather that the irresposible parents that couldn't bother themselves to teach thier children about real life.

Every single day I lose more and more hope for the human race if this is really the best we can do.

The only thing that perhaps changed for these two is they swapped the 'homophobe/racist/etc' motivation element for 'random', (which isn't especially creative), but the problem was obviously with them in the first place.

When people kill because jesus or satan told them to, the church/bible doesnt get sued/rated just because they have no self control or ability to determine between fantasy and reality, and various other oddities to their psyche.

I agree completely.

Music and videos and games DO affect those who have little capability to distinguish between reality and fantasy.

F'rinstance-How else can ya explain a couple generations of kids talking like they're brain-dead. (ebonics).

My stepson, who is 12 years old spends half of his time thinking he is a character from Tekken, and the other half of the time he's some "Brock somebody" wrestler.

Sure-I tell him that Tekken is just a game and wrestling is just an act, but he wants to believe so bad.

He's still in his formative years and has yet to really get into the whole "who am I" thing that'll prolly dominate most of his teen years. And when he tries to put a wrestling move on his little sister, he gets my own version of a dad move upside his nappy lil' haid for a reality check.

Whatever happened to the parents being responsible for the actions of their minor children?

The law (here, anyways) says that this is the way it is-what the hell does this have to do with a video game? Or the company that made it?

The kid(s) should be held responsible and the parents who should've been guiding and teaching them should be held responsible.

If I was the judge, I would just close this case without givin' any trouble to the GTA creators... But you know what I think will really happens? Well, I'll tell you! Our society have this big problem called "Itsnotmyfaultitseveryoneelsesone", which mean that the parents will surely win that case... I just remember when I was a kid around 12 years old and that the Power Rangers phenomenon hit us, young kids, pretty hard. Well, here in Canada, every channels that presented the show had to take it off their programmation... Why? Well it's really simple... One kid up here in Canada got this Power Rangers toy (somekind of dagger/gun thing) and he replaced the plastic dagger by a real knife and killed a young girl. Yup... So instead of making some prevention against violence in all of it's glory, Canada decided to ban 1 show... It's more easy to blame a show than blaming the STUPID person who did the act... So... Let's return to the GTA thingamagin. I really think the parents will win cuz the society don't want to have to deal with a problem... Instead they just close theirs eyes and pretend it just doesn't exist...

A read an articel a while back about this subject. Some psycholigists(or something) said that violent games actually doesnt affect the persons playing them. So if people do things like that I suppose that they are just plain sick, its like that dude a few years ago that when berserk on a school in the USA, played to much doom.

But its a sick world, just this Friday, some boys(we call them truckers) tryed to make me and two of my friends fight them, they provoked us and pushed us(you know, that game when a person pushes a other person and he "unfortunately" hits another). It all ended with one of the truckers a ugly fat guy, punched my friend Davin in the head and splitet his upper lip. after that he ran home, guess he couldnt overcome to take stand up for his actions. God what a jerk, fortunately we now know who he is! :cool:

Yeah.. I played Doom until I saw Cacodemons in my dreams-but that's the only other place I saw them! I play Carmageddon, but I don't(as much as I'd really like to)drive like that in real life(mainly because the physics aren't the same and crashin' hurts).

I play "Postal", too-it's a way of taking out my frustrations sometimes.

What's funny is when yer confronted with a wrestler wannabe or "kung-fooey" poser...One good rap inna nuts and he don't wanna play anymore.

I remember a couple of those from way back in junior high school.

All those too-stupid-to-breathe type lawsuits are only about going after the deep pockets.......also fits right into the "everyone's a victim" creed. It's interesting to see how many of us played horribly violent video games and watched horror flicks as kids and still didn't turn into homicidal maniacs(of course, according to the socialists/trial lawyers/govt is your daddy types, it's only blind luck, I know)......gee, I really wonder why......maybe the problem lies w/ the little f*cks and their inept parents in the first place?

Unfortunately, we'll keep seeing this kind of stuff as long as we don't get a decent reform of torts laws at the federal level......I don't see that happening soon.

Sometimes I dream of bright flashes and mushroom clouds.......

damnit... i have loads of good thing to say... but then i cant translate the stuff :mad:

but the basics are alredy said...

The fact... Movies create killers... hmm... woudnt think so... as voilence has exsisted... WAY before movies, but indeed it will affect those "weak" and "not reality telling" peps :sad:

games on the otherhand... are more like advancements in the deal of moovies... as ye can select what and who ye wanna kill (as a mater of fact... if ye wanna kill)

Music... that in otherhand... specilay some sorts like gangsta/ghetto rap... they complain on that the police make it hard for them... well, they put themself in that position... and the music defenetivly affect at earlier (unfortunly in the forming personality ages) age, as when listening to some of those musics on teh radio or cds (wich are easier to get hold of than games) where the singers are singing about killing cops, raping and sutch... or dooing drugs for that matter... will have a MAJOR effect on the listeners... specialy the 7-8 yr olds... who listen to that music



Id say to those guys... cant ye think for yer self, rather than belicing that games define what will happen in relity (offcorse, they might complain on that they dont understand)

WOW! Is that news or what.

I have two opinions to this. Firstly if these dumbass kids were influenced by GTA (unlikely) then I just don't know how they can even think of shooting cars passing by. I completely agree with Forsaken Brolly, they should'nt even have the games in the first place. Even though I am only 16 years old, I have enough brains to say that shooting cars is wrong!

And Rockstars are only creating entertainment for adults so it can be for fun and no one gets hurt! Thats why those games are created. To make people experience what it would be like to shoot thing and stuff, so no one gets hurt in real life!

So overall I think those kids are just plain stupid......STUPID I TELL YOU!!!
